Engage in fraudulent transactions, payment disputes, or abusive chargebacks;
Use the Platform to infringe the rights of another person or entity; or

We reserve the right to suspend or terminate access to the Platform and refuse transactions that we reasonably believe violate these Terms or create legal, regulatory, security, fraud, or reputational risks.

Cbdsky.com DISCLAIMS ALL WARRANTIES, REPRESENTATIONS, AND CONDITIONS, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, AND RESULTS.

WE DO NOT WARRANT THAT:

THE PLATFORM WILL OPERATE WITHOUT INTERRUPTION;
THE PLATFORM WILL BE ERROR-FREE OR SECURE;
INFORMATION PROVIDED ON THE PLATFORM WILL ALWAYS BE ACCURATE, COMPLETE, OR CURRENT;
PRODUCTS WILL MEET YOUR INDIVIDUAL EXPECTATIONS;
PRODUCTS WILL PRODUCE A PARTICULAR RESULT;
THE PLATFORM OR PRODUCTS WILL BE AVAILABLE IN YOUR JURISDICTION; OR
DEFECTS OR ERRORS WILL ALWAYS BE CORRECTED.

Nothing in these Terms excludes a warranty or right that cannot legally be excluded.

15. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Cbdsky.com, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, REPRESENTATIVES, LICENSORS, SUPPLIERS, SERVICE PROVIDERS, SUCCESSORS, AND ASSIGNS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, ENHANCED, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, LOSS OF BUSINESS OPPORTUNITY, LOSS OF GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO:

Your use or inability to use the Platform;
Your purchase, possession, or use of any Product;
Your reliance upon information provided through the Platform;
Any adverse reaction or alleged injury;
Product labeling or packaging;
Shipping delays;
Third-party services;
Website interruptions;
Unauthorized access;
Errors, omissions, or inaccuracies;
Your violation of these Terms; or
Any other matter relating to the Platform or Products,

REGARDLESS OF THE LEGAL THEORY ASSERTED, INCLUDING CONTRACT, WARRANTY, NEGLIGENCE, STRICT LIABILITY, TORT, STATUTE, OR OTHERWISE, EVEN IF Cbdsky.com HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF Cbdsky.com ARISING OUT OF OR RELATING TO THE PLATFORM, THESE TERMS, OR ANY PRODUCT PURCHASE SHALL NOT EXCEED THE GREATER OF:

(A) THE AMOUNT ACTUALLY PAID BY YOU TO Cbdsky.com FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED DOLLARS ($100).

This limitation applies regardless of the number of claims asserted.

Nothing in these Terms is intended to exclude liability that cannot legally be excluded or limited.

16. RELEASE

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU RELEASE AND FOREVER DISCHARGE Cbdsky.com AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, LICENSORS, SUPPLIERS, SERVICE PROVIDERS, SUCCESSORS, AND ASSIGNS FROM CLAIMS, DEMANDS, DAMAGES, LOSSES, LIABILITIES, COSTS, AND EXPENSES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM OR PRODUCTS, INCLUDING CLAIMS ARISING FROM YOUR OWN USE, MISUSE, IMPROPER USE, FAILURE TO FOLLOW PRODUCT DIRECTIONS, FAILURE TO REVIEW WARNINGS, OR FAILURE TO DETERMINE WHETHER A PRODUCT IS APPROPRIATE FOR YOU, EXCEPT TO THE EXTENT SUCH RELEASE IS PROHIBITED BY APPLICABLE LAW.

17. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Cbdsky.com and its owners, officers, directors, employees, contractors, agents, licensors, suppliers, service providers, successors, and assigns from and against any and all claims, demands, actions, proceedings, liabilities, damages, judgments, settlements, penalties, fines, costs, and expenses, including reasonable attorneys’ fees and litigation expenses, arising out of or relating to:

Your breach of these Terms;
Your violation of any law, regulation, or third-party right;
Your misuse of the Platform or Products;
Your fraudulent or deceptive conduct;
Any claim resulting from content or information submitted by you;
Your infringement or alleged infringement of intellectual property rights; or
Your negligence, willful misconduct, or unauthorized conduct.

This obligation survives termination of your account, these Terms, or your relationship with Cbdsky.com.

18. CHARGEBACKS AND PAYMENT DISPUTES

You agree to contact Cbdsky.com before initiating a payment dispute or chargeback concerning an order.

Fraudulent, abusive, or unauthorized chargebacks may result in account suspension, order cancellation, collection activity, or other remedies available to Cbdsky.com.

Nothing in this section prevents you from disputing a genuinely unauthorized transaction.

19. FORCE MAJEURE

Cbdsky.com shall not be responsible for delays, failures, interruptions, losses, or inability to perform caused by circumstances beyond our reasonable control, including natural disasters, severe weather, fire, flood, earthquake, epidemic, pandemic, war, terrorism, civil unrest, governmental action, embargoes, labor disputes, strikes, transportation interruptions, supply shortages, energy shortages, telecommunications failures, internet outages, cyber incidents, infrastructure failures, payment-processing failures, carrier disruptions, or other events beyond our reasonable control.

20. THIRD-PARTY SERVICES AND LINKS

The Platform may contain links to third-party websites, applications, payment processors, shipping providers, social-media platforms, advertising services, or other third-party services.

Cbdsky.com does not control and is not responsible for the content, policies, security, availability, accuracy, practices, or performance of third-party services.

Your use of third-party services may be subject to separate terms and privacy policies.

21. INTELLECTUAL PROPERTY

All content appearing on the Platform, including text, photographs, graphics, logos, trademarks, service marks, designs, product descriptions, videos, software, code, page layouts, compilations, and other materials, is owned by or licensed to Cbdsky.com unless otherwise stated.

You may not reproduce, copy, modify, distribute, publish, transmit, display, sell, license, create derivative works from, or commercially exploit Platform content without prior written authorization.

Nothing contained on the Platform grants you any license or ownership interest in any intellectual property belonging to Cbdsky.com.

The content does not violate another person’s rights;
The content does not contain unlawful, defamatory, fraudulent, or misleading material; and
The content does not violate these Terms.

By submitting User Content, you grant Cbdsky.com a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, modify, publish, display, distribute, and otherwise use the User Content in connection with our business and marketing.

You understand that we may moderate, edit, reject, remove, or discontinue publication of User Content at our discretion.

23. WEBSITE SECURITY

You agree not to interfere with or compromise the security or functionality of the Platform.

You may not attempt to:

Access restricted areas;
Circumvent authentication;
Introduce malicious software;
Conduct denial-of-service attacks;
Scrape information through unauthorized means;
Reverse engineer the Platform;
Probe or test vulnerabilities without authorization; or
Interfere with servers, networks, databases, or security systems.

Unauthorized activity may result in termination of access and referral to appropriate authorities where warranted.

26. TERMINATION OF PLATFORM ACCESS

We may suspend or terminate your access to the Platform, account, or other services at any time if we reasonably determine that you have violated these Terms, created a security or legal risk, engaged in fraud or abuse, or otherwise misused the Platform.

Termination does not eliminate obligations or liabilities that accrued before termination.

Provisions that by their nature should survive termination—including intellectual property, indemnification, disclaimers, limitations of liability, dispute resolution, arbitration, confidentiality, and payment obligations—shall survive.

27. COPYRIGHT POLICY AND DMCA NOTICE

A copyright infringement notice should contain substantially the following information:

Contact information sufficient to permit communication with the complaining party;

28. DISPUTE RESOLUTION

Before initiating formal proceedings, you and Cbdsky.com agree to make a good-faith effort to resolve any dispute informally.

If the dispute cannot be resolved informally, the dispute shall be resolved in accordance with the dispute-resolution provisions below, to the maximum extent permitted by applicable law.

29. BINDING ARBITRATION

Except where prohibited by applicable law or where a claim qualifies for a legally available small-claims procedure, any dispute, controversy, or claim arising out of or relating to these Terms, the Platform, a Product, an order, or the relationship between you and Cbdsky.com shall be resolved by binding individual arbitration rather than in court.

The arbitration shall be administered by a recognized arbitration provider under its applicable rules, unless the parties agree otherwise.

The arbitration shall be conducted on an individual basis.

The arbitrator shall have authority to award the same individual remedies that a court could award under applicable law, subject to these Terms.

Nothing in this section prevents Cbdsky.com from seeking temporary, preliminary, injunctive, equitable, or other relief from a court of competent jurisdiction when necessary to protect intellectual property, confidential information, prevent unauthorized use of the Platform, prevent fraud, or preserve the status quo pending arbitration.

30. CLASS ACTION WAIVER

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AND Cbdsky.com AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN THAT PARTY’S INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF, CLASS MEMBER, REPRESENTATIVE, OR PARTICIPANT IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION.

UNLESS OTHERWISE REQUIRED BY APPLICABLE LAW, THE ARBITRATOR MAY NOT CONSOLIDATE THE CLAIMS OF MULTIPLE PERSONS OR PRESIDE OVER ANY FORM OF REPRESENTATIVE OR CLASS PROCEEDING.

31. JURY TRIAL WAIVER

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AND Cbdsky.com KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A JURY TRIAL FOR CLAIMS SUBJECT TO LITIGATION RATHER THAN ARBITRATION.

32. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict-of-law principles, except to the extent that applicable mandatory law requires the application of another jurisdiction’s law.

To the extent a court proceeding is permitted under these Terms, the parties consent to the jurisdiction of courts having appropriate jurisdiction in Texas, subject to any mandatory jurisdictional rights that cannot legally be waived.

33. TIME LIMIT FOR CLAIMS

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF OR RELATING TO THESE TERMS, THE PLATFORM, OR ANY PRODUCT MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CLAIM OR CAUSE OF ACTION ACCRUED.

ANY CLAIM NOT COMMENCED WITHIN THAT PERIOD SHALL BE PERMANENTLY BARRED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

This limitation does not apply where a longer period is required by applicable law and cannot legally be waived.

34. SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid, void, or unenforceable, that provision shall be modified or limited to the minimum extent necessary to make it enforceable.

If modification is not possible, the provision shall be severed, and the remaining provisions shall remain in full force and effect.

35. NO WAIVER

The failure of Cbdsky.com to enforce any provision of these Terms shall not constitute a waiver of that provision or the right to enforce it later.

Any waiver must be expressly provided in writing by an authorized representative of Cbdsky.com.

36. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy, Return Policy, Disclaimer, and other policies expressly incorporated herein, constitute the entire agreement between you and Cbdsky.com concerning the Platform and supersede all prior or contemporaneous representations, communications, agreements, and understandings concerning the same subject matter.

37. MODIFICATION OF TERMS

Cbdsky.com reserves the right to modify, amend, supplement, or replace these Terms at any time.

Updated Terms may be posted on the Platform with a revised effective date.

Your continued use of the Platform following publication of updated Terms constitutes acceptance of the revised Terms to the extent permitted by applicable law.

For material changes where notice is required, Cbdsky.com may provide additional notice through the Platform, email, or other reasonable means.

38. ELECTRONIC COMMUNICATIONS AND SIGNATURES

By using the Platform, submitting an order, creating an account, communicating electronically with Cbdsky.com, or accepting these Terms electronically, you consent to receive communications electronically.

You agree that electronic records, notices, disclosures, acknowledgments, and agreements may satisfy legal requirements that such communications be provided in writing.

Where permitted by law, electronic acceptance shall have the same force and effect as a handwritten signature.
